Effective date: September 13, 2026
These Terms of Service (“Terms”) govern your access to and use of the S’amores website, applications, tools and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms.
If you do not agree to these Terms, you should not use the Services.
S’amores provides tools related to content planning, publishing, analytics, marketing intelligence, audience research, experimentation, business goals and other creator and marketing workflows.
Certain features may connect to third-party platforms and services, including social media, analytics, advertising, storage, email marketing and artificial intelligence providers.
Some features may not be available at all times, may remain in development, or may depend on access granted by third-party providers.
You must have the legal capacity to enter into these Terms and to use the Services in compliance with applicable law.
If you use the Services on behalf of a business or organization, you represent that you have authority to act on its behalf.
You must also satisfy any age, eligibility, account-status or other requirements imposed by each third-party platform or service that you choose to connect to S’amores.
For example, a connected social media, advertising, analytics or storage provider may impose its own minimum age requirements, account eligibility rules, professional-account requirements or geographic restrictions.
S’amores does not override those requirements. If you are not eligible to use a particular third-party service or integration under that provider’s rules, you may not use S’amores to access that integration.
You may not use the Services if doing so would violate applicable law, these Terms, or platform rules or contractual obligations that apply to you.
Certain features may require an account, authentication or connection to third-party services.
You are responsible for:
You must not attempt to access another person’s account or use credentials that you are not authorized to use.
The Services may allow you to connect accounts or services provided by third parties, such as:
When you connect a third-party service, you authorize S’amores to access and process information from that service within the permissions you grant.
You are responsible for ensuring that:
Third-party services are not controlled by S’amores.
Their availability, APIs, permissions, functionality, limits and policies may change at any time.
S’amores is not responsible for outages, restrictions, suspensions, policy changes or other actions taken by third-party providers.
You retain ownership of content, media, text, files, business information and other materials that you provide to or connect with the Services, subject to any rights held by third parties.
You grant S’amores a limited right to process, store, transmit, display and otherwise use those materials only as necessary to operate the Services and provide the functionality you request.
You represent that you have the necessary rights and permissions to use any content or material you submit, upload, connect or publish through the Services.
You must not use the Services to upload, process or distribute material that:
Where supported, the Services may allow you to prepare, schedule or publish content to connected platforms.
You are responsible for reviewing:
S’amores may provide previews, scheduling tools or automation, but cannot guarantee that a third-party platform will accept, process or publish content successfully.
Publication may fail or be delayed because of:
Where possible, the Services may display a failure or status message so that you can take appropriate action.
The Services may display or calculate analytics, performance metrics, audience information, advertising information, conversions, growth rates, experiment results and other marketing data.
These values may depend on:
Different providers may define metrics differently.
Data may also be delayed, incomplete, revised or unavailable.
S’amores does not guarantee that every metric will exactly match every third-party dashboard at all times.
You should not treat analytics displayed through the Services as accounting, tax, legal or financial records unless you have independently verified them for that purpose.
The Services may generate or display recommendations, planning suggestions, experiments, observations, insights or marketing intelligence.
Such information is intended to assist decision-making and does not guarantee a particular commercial, financial, marketing or audience outcome.
You remain responsible for deciding whether to act on a recommendation.
S’amores does not guarantee:
Certain features may use artificial intelligence to provide analysis, summaries, explanations, classification, suggestions or conversational assistance.
AI-generated output may contain errors, omissions or incorrect interpretations.
AI output should therefore be reviewed before being relied upon or used to make material decisions.
Unless a feature clearly states otherwise, AI-generated suggestions do not automatically:
Where an AI feature proposes an action, the Services may require your confirmation before the action is performed.
S’amores does not represent AI-generated output as professional legal, accounting, medical, financial or other regulated professional advice.
The Services may allow you to create or analyze marketing experiments and compare content, platforms, formats, audiences or strategies.
Unless expressly stated otherwise, these comparisons are descriptive.
They do not establish scientific causation, statistical significance or certainty that one action caused a particular result.
Past performance does not guarantee future results.
Where supported, S’amores may retrieve or analyze advertising information from connected advertising platforms.
S’amores does not automatically manage advertising campaigns unless a specific feature expressly states otherwise and you authorize that action.
Calculated values such as CPC, CPM, conversion cost or return on advertising spend may depend on the completeness and definitions of the underlying data.
You remain responsible for advertising budgets, campaigns, targeting and spending performed through third-party advertising platforms.
The Services may allow you to collect, import, organize or analyze audience questions, public market signals, mentions, topics, trends or research.
External signals may be incomplete, unrepresentative or inaccurate.
A trend or signal identified by the Services does not necessarily represent your entire audience or market.
You are responsible for evaluating the relevance of such information before acting upon it.
We take reasonable measures to operate and protect the Services, but you should maintain appropriate copies of information that is important to you.
Where the Services provide export or backup functionality, you are responsible for using those features as appropriate for your needs.
Some categories of operational information, security records or service-provider records may not be included in ordinary workspace exports or backups.
For information about personal-data retention and deletion, please refer to our Privacy Policy.
The Services may depend on third-party products, APIs, infrastructure or platforms.
S’amores does not control third-party services and cannot guarantee that they will remain available or continue to provide the same functionality.
A third-party provider may:
S’amores may modify or discontinue affected integrations where necessary in response to such changes.
Your relationship with a third-party provider is also governed by that provider’s own terms and privacy policies.
You may not use the Services:
You also may not attempt to reverse engineer, disrupt or exploit the Services except where applicable law expressly permits such activity.
The S’amores name, branding, software, interfaces, design, documentation and original materials made available through the Services are owned by or licensed to S’amores, except for content owned by users or third parties.
These Terms do not transfer ownership of S’amores intellectual property to you.
You may not reproduce, distribute, sell or create unauthorized derivative products from the Services except where expressly permitted.
We may modify, improve, add, remove or discontinue features of the Services.
We do not guarantee uninterrupted or error-free availability.
Maintenance, provider outages, security incidents, technical problems or third-party changes may temporarily affect access.
Where reasonably possible, we may provide notice of significant changes.
We may restrict or suspend access to the Services where reasonably necessary because of:
Access to individual integrations or features may also be automatically restricted, suspended or disabled if a connected third-party provider:
Such an event may affect only the relevant integration rather than the rest of the S’amores Services.
Where possible, the Services may notify you that a connection requires reconnection, reauthorization or another action before functionality can resume.
S’amores is not responsible for a third-party provider’s decision to revoke, restrict or terminate access to its services.
You may stop using the Services at any time.
Termination of your use of S’amores does not automatically terminate your relationship with independently operated third-party platforms.
The Services are provided on an “as is” and “as available” basis to the extent permitted by law.
We make reasonable efforts to provide reliable Services but do not guarantee that:
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, S’amores will not be liable for indirect, incidental, special, consequential or similar losses arising from your use of the Services, including loss of revenue, business opportunity, data, audience reach or expected results.
S’amores is not responsible for losses caused by third-party services, including social networks, advertising platforms, cloud providers, analytics providers, email providers or storage providers.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
To the extent permitted by applicable law, you agree to be responsible for claims arising from:
This section does not apply where prohibited by applicable consumer law.
Our collection and use of personal data is described in the S’amores Privacy Policy.
The Privacy Policy forms part of the framework governing your use of the Services.
We may update these Terms from time to time, including when:
The latest version will be published on the S’amores website with its effective or updated date.
If a material change requires additional notice or consent under applicable law, we will provide it.
These Terms are governed by the laws applicable to the operator of S’amores, subject to any mandatory consumer-protection or data-protection rights that apply based on the user’s jurisdiction.
Nothing in these Terms removes rights that cannot legally be waived.
